Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that those involved deserve clear answers about what happened. That may seem simple, but in my experience, crashes involving both pedestrians and vehicle occupants can be particularly complex, and key details are often left unexplored. To fully understand what led to this incident, three critical questions must be asked.
First, did authorities conduct a thorough investigation? Given that the crash involved a pedestrian on the interstate, investigators will likely focus on why the pedestrian was on the roadway. But just as important is understanding the driver’s actions. Was the Chevrolet driver speeding? Were they able to see the pedestrian in time to react? Did road lighting or other environmental factors contribute to the crash? Additionally, the fact that a passenger was ejected raises further concerns: were they wearing a seatbelt, or was there another reason they were thrown from the vehicle? A full investigation should consider all these factors before reaching any conclusions.
Second, has anyone considered whether a vehicle defect contributed to the crash? The Chevrolet Blazer involved in the accident is an older model, and with aging vehicles, mechanical failures become more likely. Were the brakes functioning properly? Did the vehicle’s lighting system allow the driver to see clearly? If the passenger was ejected, were the seatbelts or door latches working as they should have? These are all questions that need to be asked because mechanical failures, while often overlooked, can play a significant role in crashes like this.
Finally, has all available electronic data been collected? While older vehicles may not store as much data as newer models, the Blazer may still have a black box that contains information about speed, braking and steering input before impact. Additionally, nearby surveillance cameras or traffic footage could provide valuable insight into how the crash happened. And as always, reviewing cell phone records is critical to determining whether distraction played a role. Securing this evidence quickly is essential before key details are lost.
At the end of the day, two people were seriously injured, and the least that can be done is to ensure a full and fair investigation that leaves no stone unturned. The individuals involved deserve real answers, and the only way to get them is by asking the right questions and making sure every piece of available evidence is carefully examined.
