Commentary by Attorney Michael Grossman

When people are seriously hurt in a crash like the one reported along Interstate Highway 45, it’s important to recognize that the first reports rarely tell the whole story. After more than 30 years handling serious accident cases across Texas, I know that getting real answers starts with asking the right questions.

First, did the authorities thoroughly investigate the crash? Wrong-way accidents are often assumed to be the result of intoxication or driver confusion, but those are conclusions, not evidence. A proper investigation should consider the layout and signage of the roadway, lighting conditions, and whether there were factors that made the wrong-way movement more likely.

Second, has anyone looked into whether a vehicle defect contributed to the crash? It’s possible that a mechanical failure—such as steering or braking issues—could cause a driver to lose control and enter the wrong lanes. Without examining both vehicles carefully, it’s impossible to rule that out.

Third, has all available electronic data from the vehicles been preserved? Modern cars often record vital information like speed, steering input, and braking behavior immediately before a crash. Securing and reviewing that data can be crucial to understanding exactly what happened and why.

Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it’s the least that can be done to help those affected find the clarity and closure they deserve.
