Commentary by Attorney Michael Grossman

When I read about incidents like this, my immediate concern is ensuring the proper steps are taken to understand what caused the crash. Accidents involving a vehicle leaving its lane and colliding with a stationary object can have many underlying causes. To uncover the truth and provide clarity for those affected, it’s essential to consider three key questions.

First, did the authorities thoroughly investigate the crash? Initial reports suggest the vehicle left the roadway for unknown reasons, but determining the cause requires a comprehensive investigation. Officials should examine the roadway for signs of sudden steering maneuvers, braking, or other indications that the driver attempted to avoid something. Environmental factors, such as road design, poor visibility, or debris on the roadway, must also be considered. It’s critical that the investigation includes witness statements, if any, as well as a detailed review of the scene to reconstruct the sequence of events.

Second, has anyone looked into the possibility that a vehicle defect caused the crash? While driver behavior and road conditions are often the first factors examined, mechanical failures can also cause or contribute to accidents like this one. A malfunction in critical systems, such as the steering, brakes, or suspension, could explain why the vehicle left its lane. Additionally, issues with tires, such as blowouts or tread separation, may also be relevant. Investigating these possibilities requires preserving the vehicle for a thorough mechanical inspection, something that is not always done unless specifically requested.

Finally, has all the electronic data relating to the crash been collected? Modern vehicles are often equipped with event data recorders that can store crucial information such as speed, braking inputs, and steering actions leading up to a collision. This data can help clarify whether the driver took corrective actions or if the vehicle behaved unexpectedly. Surveillance footage or traffic camera recordings, if available, can also provide critical context about the moments leading up to the crash. Ensuring that this evidence is preserved early in the investigation is essential to gaining a complete understanding of the event.

Answering these three questions is crucial for those impacted by this collision. Crashes like this one not only result in physical harm but also leave families and communities searching for answers. A thorough investigation that examines all possible factors ensures accountability, provides clarity to those affected, and helps prevent similar incidents in the future.
