Commentary by Attorney Michael Grossman

When I hear that a 58-year-old man was struck and killed by a vehicle that then fled the scene, my first reaction is that I hope investigators are able to get to the bottom of what happened and provide the victim’s loved ones with the answers they deserve. While the case is still unfolding, there are three critical questions that always guide my thinking in incidents like this: Did the authorities thoroughly investigate the crash? Has anyone looked into whether a vehicle defect could have played a role? And has all the electronic data related to the crash been collected?

In any hit-and-run, the initial focus is understandably on locating the vehicle and driver responsible. But while law enforcement pursues those leads, it’s just as important to ensure that the investigative groundwork is laid thoroughly. That means securing the crash scene, gathering witness accounts, and checking for nearby cameras that may have captured useful footage. Yet the truth is, not all departments have the same training or resources to handle fatal crash investigations at the level they deserve. If the scene wasn’t fully documented or if potential witnesses weren’t promptly interviewed, crucial evidence could be lost.

Next, even though it may seem like this crash was caused solely by a fleeing driver, I’ve seen enough cases to know that we can’t rule out the possibility of a vehicle defect playing a role. For example, unintended acceleration, faulty brakes, or steering issues might have contributed to the driver losing control. It’s especially hard to assess this in a hit-and-run where the vehicle hasn’t been recovered. That’s why it’s vital that if and when the Toyota Corolla is found, it be preserved and thoroughly examined by someone with the right expertise. Unfortunately, vehicles are often repaired or scrapped before anyone has a chance to inspect them properly, and that makes it nearly impossible to identify underlying mechanical issues.

Finally, the question of electronic data can’t be overlooked. Modern vehicles, including a Toyota Corolla, often contain an engine control module that records speed, braking, and throttle inputs in the moments before a crash. Cell phone data from the fleeing driver, if recovered, might also offer insight into what they were doing at the time—whether they were distracted, using GPS, or even communicating with someone. Video from nearby businesses or residential doorbell cameras can sometimes show more than just the moment of impact; they might provide clues about how the vehicle was being driven beforehand or where it went afterward. But all of this data is time-sensitive. The longer it takes to collect it, the greater the risk it could be lost.

At the end of the day, even when a crash seems straightforward on the surface, getting to the truth requires asking the right questions early and following every lead to its end. For the man who lost his life, and for the loved ones left behind, we owe it to them to ensure that no stone is left unturned in answering how and why this happened.
