Commentary by Attorney Michael Grossman

With a single-vehicle wreck, there’s a concern that I get calls about all the time. People want to know how to tell if their situation has been handled properly. Well, there are a few key questions I’ve found to be effective at finding that out.

First, did authorities have the resources and time to investigate thoroughly? A vehicle running off the road could involve road hazards, poor visibility, or other external factors. Were these possibilities carefully examined, or could critical details have been overlooked?

Second, could a vehicle defect have contributed to the crash? Mechanical failures like brake issues, steering problems, or even seatbelt malfunctions can cause or worsen a crash. A proper inspection of the vehicle is essential to rule out any defects.

Finally, was electronic evidence preserved? The vehicle’s Engine Control Module (ECM) stores crucial data about speed, braking, and steering inputs. Other evidence, like cellphone records or nearby video footage, could also provide clarity.

If authorities can provide clear, satisfactory answers, it’s probably because they did good investigations. If they can’t, and those involved in the crash are left with unanswered questions, that can be a clear sign that there needs to be an independent investigation to fill in the blanks. Either way, it can help people assure that they’re ultimately going to get the answers and the resolution they deserve.
