Investigators said that three men were in a Hyundai Veloster going eastbound along Yorktown. A 25-year-old man was in a westbound Mercedes-Benz. Details suggest the vehicles were passing each other when they ended up colliding head-on.

Due to the collision, the Mercedes-Benz driver was seriously injured. Two people in the Hyundai had reportedly minor injuries. Right now, authorities say alcohol was a suspected factor in the crash.

When alcohol is suspected in a crash, the focus is usually on the drivers, but that’s only part of the story. A key question that often goes unanswered is where the alleged drunk driver got their alcohol and whether an alcohol provider over-served them before the crash.

Texas dram shop laws are clear: bars, restaurants, and other establishments can be held accountable if they over-serve alcohol to someone who is obviously intoxicated. If an investigation finds that an alcohol provider ignored the law and continued serving the driver past the point of intoxication, they may share responsibility for what happened if that person gets themselves or someone else hurt.

Too often, these details are overlooked in crash investigations, even though they play a major role in preventing future incidents. Holding all responsible parties accountable—including any establishment that may have broken the law—should be a focus following any serious accident.
