Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that the person involved deserves clear answers about what happened. While the initial reports provide a basic outline of the incident, they leave critical questions unanswered. In my experience, three key questions must always be addressed in any crash investigation.
The first question is whether authorities conducted a thorough investigation. Law enforcement typically documents the scene, interviews witnesses, and reconstructs the crash to the best of their ability. However, the quality of these investigations can vary depending on the training and resources available to the department handling the case. Given that this crash involved serious injuries and a vehicle fire, it’s reasonable to expect authorities to take a closer look. But even in these circumstances, important details can be overlooked, which is why an independent review may be necessary.
The second question is whether a vehicle defect may have contributed to the crash. Reports indicate that the driver lost control for “unknown reasons” before hitting a barrier and catching fire. While loss of control is often attributed to driver error, mechanical failures—such as a sudden steering malfunction, brake failure, or tire blowout—can also cause a vehicle to veer off the road. Additionally, a vehicle catching fire after a crash raises concerns about potential fuel system defects or electrical malfunctions. Unfortunately, vehicle defects are often dismissed unless someone specifically investigates them. If the vehicle is disposed of before an expert can inspect it, a critical piece of the puzzle may be lost.
The third question concerns electronic data collection. Modern vehicles are equipped with electronic control modules (ECMs), which store valuable crash-related data such as speed, braking, and steering inputs. Additionally, cell phone records and nearby surveillance footage could provide crucial context about the moments leading up to the crash. If this data isn’t secured quickly, it can be lost or overwritten, making it much harder to piece together an accurate picture of what happened.
Ultimately, every serious crash deserves a full and complete investigation. When someone is severely injured, the least the community owes them is an honest effort to determine exactly why the crash occurred. If questions remain unanswered, it’s important to seek out those who can find the missing pieces and ensure that no potential factor—whether human, mechanical, or environmental—is overlooked.
