Accident Report

February 18, 2026, a woman was injured due to a car versus pedestrian accident which occurred around 11:10 p.m. along East Bayshore Drive.

Investigators said that the accident took place in the Dickinson/San Leon area near 27th Street. It appears that a 30-year-old woman was on foot at the time along the roadway. A Nissan Versa was going westbound, and it struck the pedestrian.

Due to the accident, the woman was seriously injured. No further injuries were reported. Additional details are unavailable.

How Did This Accident Occur?

Pedestrian accidents have a reputation of being simple, as people think it all comes down to who had the right-of-way. Right-of-way is very important, and maybe this all happened simply because someone was in the wrong place at the wrong time. However, the law is more nuanced than that, and I’ve seen many investigations that focused solely on right-of-way overlook crucial factors.

For example, let’s say a pedestrian crosses the middle of a roadway where there’s no crosswalk. If a driver has no way of seeing and avoiding them in time, it would obviously be ridiculous for them to bear any responsibility for a resulting accident. But if that driver was texting and driving, and evidence shows that they had enough time to slow down but failed to do so, then they wouldn’t get a free pass simply because the victim was outside of a crosswalk. In a situation like that, it would ultimately be up to a jury to decide whose actions were more in the wrong.

In those situations, I’ve seen juries go either way. But generally, the side with the most convincing evidence telling their side of the story will be the one that’s more likely to prevail. I don’t see any reason right now why this accident would be an exception.
