Commentary by Attorney Michael Grossman

One thing I haven’t seen authorities talk about is the exact timing of the events here. One of the reasons in-depth accident reconstructions are so important is because finding out how a crash could have been avoided may came down to fractions of a second.

Here, for example, I’m wondering if the truck driver looking for cross traffic and thinking they could turn safely onto the service road was reasonable. If a prudent professional driver would have seen the victim and waited for them to pass, what was different about this driver’s decision? Frankly, authorities are not always motivated to get so granular in their efforts, so it can take more thorough independent investigations to really determine how a commercial truck accident could have been avoided and why it wasn’t. Are those efforts happening here?
