Commentary by Attorney Michael Grossman

When I hear about a crash where an SUV rear-ended a stopped school bus, my first question is, “What prevented the driver from stopping in time?” Many people assume that rear-end collisions are always the fault of the trailing driver, but in my experience, there are often other factors that need to be considered.

One key factor for investigators to consider is visibility. School buses are large, but if this crash happened just after sunrise, sun glare could have made it difficult for the SUV driver to see the stopped bus in time. I’ve seen cases where early morning light created near-blinding conditions, making it hard for drivers to react quickly enough. Investigators should consider whether the position of the sun and any obstructions along the road may have affected the driver’s ability to see the bus clearly.

Beyond that, speed and road conditions matter. Was the SUV traveling at a safe speed for the area? Were the roads wet or icy? Investigators should examine skid marks, vehicle data and any nearby traffic signs to determine whether speed or road conditions played a role in the crash.

It’s also worth verifying whether the bus’s warning lights and stop arm were properly activated. While buses are designed to be highly visible, mechanical failures or improper use of safety equipment could have contributed to the crash.

At this stage, there are too many unanswered questions to assume that this was simply a case of a driver not paying attention. That’s why a thorough investigation is necessary: one that looks at all potential contributing factors, not just the fact that one vehicle hit another from behind.
