Commentary by Attorney Michael Grossman
When an accident involves a private passenger bus and an SUV on a major highway, there is often an assumption that the SUV driver alone is responsible for the collision. However, my experience handling commercial vehicle accident cases has shown that such incidents frequently involve multiple contributing factors that need thorough investigation to fully understand what went wrong.
One critical avenue of inquiry in this case is whether the bus was safely and properly operating at the time of the crash. Did the bus driver follow proper protocols for lane usage and speed? Was the bus stopped or traveling unusually slowly, and if so, were there sufficient warnings to alert other drivers? Private passenger buses are held to strict safety standards, and any failure in their operations—whether due to driver error or mechanical issues—could have played a role in the collision.
Similarly, the condition and maintenance of the bus itself are key factors to examine. Were all required lights, reflectors, and other visibility-enhancing measures in good working order and clearly visible? A lack of functioning brake lights or reflective materials could drastically reduce the time another driver has to react, especially at highway speeds in low-light conditions, like those at 1:30 a.m.
The bus company’s practices and policies also warrant scrutiny. Companies are responsible for ensuring their vehicles are roadworthy and their drivers are trained to handle various conditions safely. Were there any lapses in vehicle maintenance, or was the bus driver under pressure to adhere to a demanding schedule, potentially leading to unsafe decisions? These are questions that must be answered to determine whether the company played a role in the accident.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure the victim’s loved ones receive the clarity and closure they deserve.
