Commentary by Attorney Michael Grossman

When most people hear about a school bus hitting four other vehicles and sending six people to the hospital, they naturally want to know one thing: How could something like this happen? It’s a fair question, especially when the vehicle involved is supposed to be one of the most carefully operated on the road. But without more details, it’s hard to say whether the bus driver made a critical mistake, or if something else put that driver, and everyone else, in harm’s way.

Was the bus in motion when it struck the other vehicles, or was it reacting to something ahead of it? Did the crash begin with another driver’s sudden maneuver or braking? Was there a mechanical failure? Right now, we don’t have those answers. All we know is that six people, including the bus driver, were hurt, and that’s reason enough to dig deeper.

From experience, I know that even seemingly straightforward crashes can involve hidden factors. For example, in past cases I’ve handled, we’ve discovered through investigation that a driver was texting, asleep at the wheel or operating under the influence; things that only came to light through reviewing phone records, black box data or dashcam footage. On the other hand, I’ve also seen cases where a bus driver was blamed at first, only for video footage to later reveal that another driver had cut them off or slammed on the brakes with no warning.

If this bus had onboard cameras, and many school buses do, those recordings could be invaluable in showing exactly what the driver saw and did in the moments before the crash. Likewise, data from the engine control module could clarify whether the bus accelerated, braked or made any sudden maneuvers. That information can make the difference between fair accountability and misplaced blame.

Of course, the investigation also has to look beyond the driver. Was the bus properly maintained? Was the driver fatigued or under pressure to finish a route quickly? These are questions only a full, independent investigation can answer. And until that happens, we’re all working with incomplete information.

Key Takeaways:

  • It’s not clear yet what caused the school bus to strike four vehicles; multiple possibilities remain open.
  • Onboard video footage and black box data could be critical in understanding the bus driver’s actions.
  • An independent investigation should also examine the bus’s maintenance, driver condition and possible outside interference.
  • Authorities haven’t said whether another vehicle’s actions contributed to the crash.
  • Getting to the truth means gathering objective evidence, not just assuming fault.
