Investigators said that a 43-year-old Buffalo man was in a Chevy Silverado going southbound on F.M. 489. It appears a deer entered the roadway, causing the vehicle to lose control and veer off-road. There, the vehicle overturned along a fence line. The Buffalo man was seriously injured as a result. Right now, further details about the crash can’t be confirmed.

When it comes to a crash like this, it’s understandable that people may think there’s nothing really to discuss. After all, it’s not like a deer can be held accountable for causing an accident. But the cause of someone’s injuries is not always the same as the thing that caused the crash itself.

For example, I handled a case where authorities were so focused on a driver’s actions that they completely missed that the victim had a defective seatbelt. Independent investigators were able to catch the defect, and they showed that the victim likely would have been fine had it not been for the faulty seatbelt—something even the driver didn’t know about until it was brought to light.

Maybe nothing like that happened here, but it’s one of the reasons I say there really are no open-and-shut accidents. There’s always the possibility something unusual contributed to the accident which authorities may have overlooked.
