Commentary by Attorney Michael Grossman

When a vehicle enters the path of another and sets off a fatal crash, the key question isn’t just what happened, but why it happened. In my experience handling accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.

Why did the Jeep enter the pickup’s path? Drivers are expected to yield when entering a highway or crossing traffic, so investigators need to determine why this one did not. Did the driver misjudge the pickup’s speed? Fail to see the oncoming truck? Was distraction or impairment involved? Reviewing witness statements, traffic camera footage, and cell phone records could help clarify what led to the crash.

Did the pickup’s trailer affect its ability to avoid the collision? Towing a trailer increases stopping distance and makes quick maneuvers more difficult. If the driver attempted to brake or swerve but was unable to avoid the Jeep, investigators should determine whether the trailer’s weight, speed, or stability played a role. Analyzing crash scene evidence, skid marks, and black box data could provide insight.

Was the pickup truck being used for commercial purposes? Many pickups and trailers are used for work-related hauling, which means there could be additional regulations involved. If the vehicle was being used for business, investigators need to determine whether it was properly maintained, loaded within legal weight limits, and operated by a driver following hours-of-service regulations. Reviewing company records, maintenance logs, and any applicable commercial driving requirements could help establish whether business-related factors played a role in the crash.

Did vehicle maintenance play a role? If either vehicle experienced mechanical failure—such as faulty brakes or steering malfunctions—that could explain why the crash occurred. Investigators should review inspection records, maintenance logs, and crash scene evidence to determine whether equipment issues contributed.

At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
