Houston, TX — September 21, 2024, Brody Whitten was killed and one was injured following an alleged DWI accident at around 9:55 p.m. on Lockwood Drive.
Authorities said in preliminary statements that the accident took place on Lockwood at Market Street, just off the East Freeway.

Details from Harris County officials say that 18-year-old Brody Whitten was driving a Dodge pickup southbound on Lockwood. At Market, a Nissan going westbound reportedly crashed into Whitten’s vehicle, causing the pickup to overturn. As a result, Whitten was killed. The other driver was injured.
Commentary by Attorney Michael Grossman
At this time, authorities allege that the Nissan driver was driving while intoxicated. If this is true, I’m rather surprised there aren’t more severe charges. Generally speaking, authorities take intoxicated driving very seriously, so there are usually intoxication manslaughter charges after a fatal wreck. But it might surprise people that authorities sometimes let even intoxicated driver accidents slip through the cracks.
For example, I’ve handled hundreds of cases involving drunk drivers who were unlawfully over-served by alcohol providers. In far too many of those cases, all kinds of evidence only came to light because the families involved sought out independent professionals. Authorities would just slap a charge on the drunk driver, then move on and leave families looking for answers on their own, despite the fact the alcohol providers we investigated could have been subject to criminal investigations, as well.
Maybe there’s more to this crash that just isn’t public yet, and maybe authorities have been thorough behind the scenes to ensure the victim’s loved ones are getting the full story. But I learned a long time ago not to just take for granted that authorities are going to get all of the facts. That’s a sure way to miss something important after a serious crash like this.
