Commentary by Attorney Michael Grossman

The reporting on this crash is short on details. Perhaps authorities have good reason for not releasing a lot of information to the press. I can’t really speak to that. My only hope is that behind the scenes they’re conducting a first-rate investigation. How will those affected know that the investigation hit all the marks? A good rule of thumb is that at the end of a proper investigation, authorities should be able to answer the following questions to the satisfaction of those affected.

1. Did the authorities thoroughly investigate the crash?

A thorough investigation will include the following:

  • Accident reconstruction: Analyzing everything from speed, tire marks, point of impact and more is essential.
  • Witness Statements: Ensuring that any witnesses are found and interviewed is important to help paint a clear picture of the facts.
  • Analysis: What were the road and lighting conditions on US-82, and could they have contributed to visibility issues? Was visibility impaired due to weather or time of day?

Unfortunately, law enforcement resources and expertise can vary, and gaps in the investigation may leave unanswered questions. Independent experts may be needed to conduct a deeper analysis.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?

While pedestrian accidents often seem straightforward, it’s essential to consider whether the pickup truck involved had any mechanical issues or design defects that played a role. Examples include:

  • Faulty brakes or steering components that prevented the driver from avoiding the collision.
  • Visibility impairments, such as defective headlights.
  • Throttle issues such as premature acceleration.

Except for the most obvious defects, it’s next to impossible to determine whether a vehicle defect played a role in a crash with an on-scene investigation. Diagnosing defects generally requires a properly equipped lab. If the investigation stops at the crash scene, it’s likely that a vehicle defect wasn’t properly considered.

3. Has all the electronic data relating to the crash been collected?

Modern vehicles are equipped with electronic systems that can provide invaluable insights into the events leading up to a crash. In this case, the pickup truck’s Electronic Control Modules (ECM’s) might reveal:

  • The driver’s speed and braking patterns.
  • Steering inputs and the timing of any evasive maneuvers.
  • GPS data showing the vehicle’s exact location at the time of the accident.

Additionally, nearby surveillance, traffic, and dash cameras could provide critical visual evidence. As important as surveillance data is, cell phone data is equally important as this can give insights into what the driver could have been doing leading up to the accident.

Accidents such as this are never straight-forward even if they appear to be at first glance, and ensuring that authorities look at every possible piece of evidence is the only way to ensure that there are no questions left unanswered.
