If the allegations here are true, have authorities clarified if alcohol or drugs were the intoxicant? This can make a huge difference legally speaking, and it could even lead to an accomplice if evidence shows this driver was unlawfully over-served by a negligent alcohol provider.
Simply put, Texas law prohibits bars and other similar establishments from serving people who are obviously intoxicated. Doing so exposes those establishments to potential legal consequences, and they can be held responsible if their actions lead to people being hurt or killed.
That’s why it frustrates me how often I’ve had cases where authorities just completely overlooked this possible factor. People rightfully want to see accountability after intoxicated driving accidents like this. That obviously includes holding an alleged intoxicated driver accountable, but just settling for pinning the blame on a single “bad guy” isn’t good enough. Families deserve to know all who wronged them will answer for their actions.
So, if there was an accomplice who contributed to a man losing his life and could be continuing to put others at risk, it wouldn’t be right to let them continue business as usual as though nothing happened. Texas law provides avenues to see all wrongdoers held accountable, and it’s important for victims and families to know if those avenues are available to them.
