Commentary by Attorney Michael Grossman
When crashes like this one occur, people might assume they’re the result of random chance or a simple lapse in judgment. However, based on my experience, accidents involving large trucks require digging into every detail to uncover all contributing factors.
What could lead an 18-wheeler to collide with an emergency vehicle stopped at the scene of a previous crash? Was the truck driver distracted or fatigued, or did they fail to properly assess the situation ahead? Could external factors like road conditions, poor lighting, or confusion about traffic control at the scene have played a role? Understanding these elements is critical to determining responsibility and preventing similar incidents.
It’s also vital to consider the actions and condition of the truck driver. Was the driver appropriately alert and aware of their surroundings, or were they dealing with fatigue, distraction, or impairment? Long-haul truckers often face grueling schedules that can lead to reduced reaction times or lapses in judgment. Additionally, was the driver adhering to reduced speed requirements near an active emergency scene, as mandated by Wisconsin’s Move Over Law? This law is designed to protect first responders and others at crash scenes, but its effectiveness relies on drivers following it.
The trucking company’s role must also come under scrutiny. Companies are responsible for ensuring their vehicles are maintained in proper working condition and that their drivers are qualified and adequately trained to handle emergency scenarios. Was the truck properly inspected and roadworthy, or did mechanical issues such as faulty brakes or tires contribute to this crash? Furthermore, trucking companies can sometimes push drivers to meet strict delivery deadlines, potentially leading to risky decisions. Investigating these things could shed light on whether or not the trucking company shares responsibility for what happened in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
