Commentary by Attorney Michael Grossman

While people tend to jump to conclusions after serious accidents, it’s important to keep in mind that there are all kinds of possible factors a truck might lose control. Some are avoidable, some aren’t.

Did the driver experience a medical emergency? Did a tire a blowout? Was the truck in a state of disrepair? Was the driver properly trained? Is there something wrong with the road the truck was on? Were there any obstructions to visibility at the time? Was there some other reckless driver who fled the scene? Was the driver under any pressure to meet unreasonable deadlines given by a negligent employer?

Likely or not, I’ve seen these factors across hundreds of commercial vehicle accident cases I’ve handled. They happen, and they need to be thoroughly investigated to make sure nothing important slips through the cracks. Maybe this was something simple, maybe it requires a more in-depth investigation, or perhaps it’s some one-in-a-million, freak occurrence. At the end of the day, if the authorities aren’t giving these possibilities and many others enough attention, they could be missing something important.
