Commentary by Attorney Michael Grossman

If the allegations here are true, then it’s likely there will be stiff consequences for the actions that led to the collision. But something else stood out to me here.

Generally speaking, a crash between two similar vehicles is going to yield similar results for the drivers, all things more or less equal. Modern vehicles are designed to dampen rear-end collisions as best as they reasonably can. So why is it that the victim here apparently had incapacitating injuries while the other driver was apparently unharmed? Could it be there was something unusual about the victim’s situation or the vehicle itself that led to more serious injuries? Is that even something authorities are working to clear up?

Like I said, I don’t have details right now not already available to the public. But I’ve encountered more than my fair share of situations where police missed something unusual because they simply weren’t looking for it. Is it possible this is another such situation?
