Commentary by Attorney Michael Grossman
When accidents like this occur, people often assume they are caused by a single driver’s error or a momentary lapse in judgment. However, as someone with decades of experience handling commercial vehicle accident cases, I can tell you that the truth often lies in a web of contributing factors that must be carefully unraveled.
What could have caused the collision between the Lexus and the 18-wheeler? Was the driver of the passenger vehicle unaware of the truck’s approach, or did they misjudge the truck’s speed or distance? Was the truck driver traveling too fast for conditions, distracted, or otherwise unable to react in time to avoid the crash? These questions must be thoroughly investigated to determine how and why the vehicles ended up in one another’s path.
The 18-wheeler’s operation and condition also deserve close examination. Commercial trucks must adhere to rigorous standards for maintenance and safety. Was this truck properly inspected and maintained? Did any mechanical issues—brake failure, worn tires, or steering problems—play a role in the driver’s ability to avoid the crash? Additionally, trucking companies are responsible for ensuring their drivers are well-trained and operating within federal hours-of-service limits to prevent fatigue. Was the driver alert and focused, or were unsafe company practices pushing them beyond their limits?
Equally significant is the role of the trucking company itself. The company’s hiring, training, and safety monitoring practices should be scrutinized to ensure they are meeting their legal and moral responsibilities. Were they diligent in ensuring the truck was roadworthy and their driver was qualified and prepared? Could improper company oversight or pressure to meet tight delivery schedules have contributed to unsafe practices that led to this accident?
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
