Officials indicate that an 18-wheeler with a trailer in tow which was also traveling eastbound on S.H. 243 behind the bicycle swerved to the right in an attempt to avoid a collision. However, a collision still occurred between the left-rear side of the trailer and the back of the bicycle. The truck allegedly fled the scene, the person(s) inside failing to stop and render aid of any sort to the victim.

The bicycle came to a stop resting on the north side of the roadway under a tree. The girl, who was thrown from the bike over the course of the accident, came to a stop resting partially on the north shoulder and partially in the westbound lane of the highway. She suffered reportedly severe injuries as a result of the wreck and was transported to a local medical facility by EMS in order to receive necessary treatment.

Additional details pertaining to this incident—including the identity of the bicyclist—are not available at this point in time. The investigation is currently ongoing.

Commentary by Attorney Michael Grossman

Oftentimes, when people hear about hit-and-run truck accidents like this one, they quickly assume it’s a clear-cut case of driver negligence. However, in my experience, these cases are rarely that straightforward. There are some critical questions that need to be answered in order to understand the full picture.

First, the truck driver’s decision to flee the scene is a serious concern. This action not only violates the law but also raises questions about the driver’s state of mind and awareness at the time of the crash. Was the driver distracted, fatigued, or possibly impaired? Investigating the driver’s background, driving history, and the company’s practices can provide insights into these questions.

Many people assume that once a vehicle leaves the scene of a hit-and-run, it’s nearly impossible to find them. However, with modern technology and thorough investigative techniques, hit-and-run drivers are often tracked down more frequently than people realize. Surveillance cameras, traffic cams, and even witness smartphones can provide crucial evidence. Additionally, many commercial trucks are equipped with GPS tracking systems that can pinpoint their location at any given time.

Additionally, the maintenance and condition of the truck should be examined. Was there a mechanical failure that contributed to the inability to avoid the collision? Regular maintenance logs and inspections are crucial in determining whether the vehicle was in proper working order.

Moreover, the truck company’s policies and training protocols must be scrutinized. Are drivers properly trained to handle emergency situations and taught the importance of stopping to render aid? Companies have a responsibility to ensure their drivers are well-prepared for all scenarios on the road.

To get to the truth of this matter, a comprehensive investigation is necessary. This means looking beyond the immediate crash scene to gather all relevant evidence, including witness statements, surveillance footage, and vehicle data. Only by piecing together all these elements can we determine the full story and hold the appropriate parties accountable.
