There seems to be a lack of clarity about the exact timing of when the victim’s vehicle supposedly broke down and when the truck crashed into it. At noon on an interstate, one would generally think a vehicle broken down in the roadway would be clearly visible and avoidable. However, it’s important that authorities waste no time in verifying this, as some vital evidence might be time sensitive.
For example, have authorities checked to see if the truck had any cameras? We had a case not long ago where that evidence proved to be indispensable. In that case, a trucking company claimed their driver hit someone who had broken down on the highway without their lights on, and there was no way to avoid the collision. Through the courts, though, we pulled video from the truck, and that whole defense went out the window. The video clearly showed the victim had their emergency lights on and was easily avoidable. That evidence was monumental in getting that family the answers they deserved that the preliminary reports never touched on.
I’m not saying anything like that happened in this crash, but people are sometimes too quick to just assume police have everything handled. It can be prudent to actually ask them questions and see if that’s the case. Either authorities will provide clear answers that show they’re being thorough, or they’ll show that the crash might need to be in the hands of independent accident reconstructionists whose attention won’t be divided between all the responsibilities a police department has on their plate.
