Commentary by Attorney Michael Grossman
When people read about an alleged drunk driver accident, they figure things are open-and-shut. The alleged drunk driver faces charges, and that’s that, right? Well, a proper investigation also needs to include where that alcohol came from. That’s because there may be a negligent alcohol provider also responsible for the accident.
In Texas, bars and other establishments are not allowed to serve people who are obviously intoxicated. Doing so can potentially expose those alcohol providers to criminal investigations, fines, suspended licenses, or liability for injuries resulting from that intoxication.
Here’s why that’s important. For one, victims and families want to see accountability. Whether it’s a drunk driver or a negligent bar, if someone breaks the law and harms people, those people will rightfully want to see those wrongdoers face appropriate consequences. Second, I’ve handled hundreds of cases against negligent alcohol providers. When they’re actually held responsible for their actions, they clean up their act. That means one less negligent establishment putting dangerous drunk drivers on the road, and that helps the whole community.
So as open-and-shut as folks may think these details are, there’s a very important detail missing from these preliminary statements. Have investigators taken the time to find out if there were any accomplices to this accident?
