Commentary by Attorney Michael Grossman
Following any accident, there can be concerns about whether or not investigations are being handled properly. I get calls all the time from folks who feel like authorities more or less brushed their situation aside and moved on without getting clear answers. That’s why I’ve found a few key questions can help people gauge if their accident needs independent investigations.
First, did authorities have the time, tools, and training to properly investigate the crash? Factors like road hazards, visibility issues, or evasive maneuvers might not be obvious without careful analysis of the scene.
Second, could a vehicle defect have contributed to the crash? Mechanical issues like brake or steering failures, or even safety system malfunctions such as seatbelts or airbags not functioning correctly, can play a significant role in single-vehicle accidents.
Finally, was all electronic evidence collected? Modern vehicles store crucial data in their Engine Control Modules (ECMs), and additional evidence like cellphone records, GPS data, or nearby video footage can help clarify the events leading up to the crash.
If authorities come up with reasonable, satisfying answers, then it’s likely that they did good investigations. But if their answers come up short or leave doubts, then the crash might need a second set of eyes to ensure nothing important slipped through the cracks.
