Commentary by Attorney Michael Grossman

One of my main concerns following any motorcycle wreck is whether or not authorities are giving it the attention it deserves. The unfortunate reality is folks tend to be negatively biased against motorcyclists, and authorities aren’t immune to this. It can lead them to jump to conclusions or otherwise overlook possibilities they’d have considered had the victim been on four wheels.

Something I learned long ago in my career is that victims at least deserve some benefit of the doubt until all the facts are clear. That means investigations should be able to consider even unlikely possible factors, such as vehicle defects, road hazards, medical emergencies, missing signage or lighting, etc. Either the investigations will catch something unusual, or they’ll help reassure a victim’s loved ones they’re getting the answers they deserve. At the end of the day, families deserve to know their loved one’s side of the story is being told fairly, and that requires letting the evidence speak for itself. Did that happen here?
