Investigators said that 75-year-old Barbara Jenkins was in a Chevy Equinox going westbound along the highway. A northbound Ford Ranger reportedly failed to yield, resulting in a collision with Jenkins’s vehicle.

Due to the collision, the Ford driver was seriously injured. Barbara Jenkins sustained moderate injuries. Authorities say that the Ford driver had been drinking, but additional details are not confirmed at this time.

That said, when alcohol is suspected, it’s important to ask more than just whether the driver was drinking—it’s also worth investigating where they got their alcohol and whether an alcohol provider over-served them.

Texas dram shop laws hold alcohol providers accountable if they serve alcohol to someone who is obviously intoxicated. If further investigation confirms that the Ford driver was impaired, it would be important to determine whether an establishment ignored their legal duty and contributed to the crash by over-serving them.

Too often, investigations stop at the driver, missing an opportunity to identify all potential wrongdoers. If alcohol was involved, a full investigation should determine whether an alcohol provider played a role.
