Commentary by Attorney Michael Grossman

In all of the chaos that can follow an accident like this, some people may be quick to assume that OSHA is going to take care of everything. The reality is efforts from OSHA are rarely enough on their own to really get a fair resolution for those affected by these accidents. OSHA has their own priorities: look for violations, and issue any necessary citations. Getting folks the actual answers they need and any potential help that’s available typically means independent efforts beyond those of officials alone. Evidence in these situations can be scattered and time-sensitive, though, which is what makes waiting around for OSHA even more risky. Their investigations can sometimes take six to 18 months. Making sure to have experienced investigators look into the details as soon as possible is much more prudent when it comes to handling an incident like this one.
