Commentary by Attorney Michael Grossman

Naturally, authorities mentioning someone being on the wrong side of the road raises red flags. That said, I always caution against jumping to conclusions, and a crash like this is no different. For example, there was a time here in DFW where a toll road was seeing an unusually high number of incidents involving wrong-way drivers. Research into the situation revealed that the warning signs along exit ramps were actually too high for drivers to see. Officials had the signs lowered, and lo and behold, the number of incidents went down.

Now, is it more likely for something like fatigue or alcohol to lead to a wrong-way accident? Of course, and I wouldn’t suggest ignoring that. That’s especially true considering how often the drivers turn out to have been unlawfully over-served by a bar, which could mean there’s a negligent alcohol provider responsible for the victim’s injuries. My point here is simply that things are rarely ever as simple as they may seem, so it’s important serious accidents always get a careful investigation from professionals.
