With these preliminary statements, it should raise serious red flags that a vehicle made a left turn into a motorcyclist’s lane, leading to a collision. Some might think that would make a situation like this open-and-shut. With motorcycle accidents, though, there needs to be as much clear evidence as possible telling the story. Otherwise, people are bound to let their negative biases warp the story to blame the motorcyclist.

This is a common bias that I’ve had to contend with many times. It can create problems for a victim’s loved ones if left unchecked. In a case I handled not long ago, for example, authorities blamed a rider for weaving through traffic and speeding before crashing into a semi. They said a witness saw this behavior, but the family knew their loved one was a safe rider and wanted to know the truth.

We went and spoke with this eye witness, and they were shocked to see what the investigating officer reported. It didn’t at all much what the witness told the officer. What the witness actually said was that the motorcyclist passed them on the left, which is a totally reasonable and legal maneuver. It was actually the truck cutting off the rider that led to the crash. The officer simply let their bias get in the way, and they got the facts wrong. Only after our independent investigations was the record finally set straight.

Unfortunately, these kinds of misinterpretations and assumptions are par for the course with motorcycle wrecks. When people don’t have all of the facts, they fill in the blanks with their own misconceptions. That’s why a family needs as much evidence on their side as possible to ensure there is a fair and just accounting of what happened to their loved one.
