UPDATE (November 26, 2024): Authorities have identified the person killed in this accident as 26-year-old Anthony Antonio Meza Moreno.

Grand Prairie, TX — October 19, 2024, one person was killed and another was arrested following an alleged DWI accident on Highway 360 in Grand Prairie.

Investigators said in preliminary statements that the incident happened around 1:40 a.m. along Highway 360 near Green Oaks Boulevard. Officials say 20-year-old Hector Garcia was traveling along the highway when his GMC Acadia rear-ended a Toyota Corolla, which was reportedly traveling slowly with its hazard lights on for unknown reasons.

The Toyota driver was fatally injured in the collision. It is unclear if Garcia was injured, but reports indicate he was arrested on a preliminary charge of intoxication manslaughter.

The accident remains under investigation. No further details are currently available.

If reports got their facts straight here, it seems one person involved in this crash was suspected of driving under the influence. Authorities recommended charges, and people may think his day in court will be more or less the end of the story. However, they may not realize that many drunk drivers have an “accomplice” of sorts that should also be investigated: An alcohol provider. If a bar, club, or restaurant keeps serving alcohol to someone who is obviously intoxicated, they are in violation of Texas dram shop law and could face serious legal repercussions.

Any time a bar keeps serving someone way past his limits, they endanger him and everyone sharing the road with him after he stumbles out the door. It seems only natural that those businesses should answer for their contribution to the thousands of drunk-driving accidents all over Texas every year. Despite that, the illegal over-service behind many DWI wrecks slips through the cracks far too often as authorities rarely look beyond the drunk drivers. In the hundreds of cases I’ve handled on behalf of drunk driving victims, we usually had to bring the negligent alcohol providers to authorities’ attention before any criminal or administrative investigations took place.

That’s one of the reasons I write about this area of the law so much. The more people know and understand about their rights, the more steps they can take to find out if authorities are looking out for their best interests—and the sooner they can seek other help if they find authorities are coming up short.
