Commentary by Attorney Michael Grossman
When it comes to accidents involving vehicles disabled on the freeway, there are generally two key factors to consider: where the vehicle was and whether or not it was visible.
It’s obviously dangerous for a vehicle to be in a lane of travel, especially on a freeway. Sometimes, though, it’s unavoidable. That’s why we have emergency lights. So if someone is stopped on a highway, but their vehicle is visible, drivers have a basic duty to be attentive enough that they can avoid the stopped vehicle.
As such, if a disabled vehicle is reasonably avoidable, and a driver fails to avoid it, it raises questions about what that driver was doing that prevented them from reacting in time. Otherwise, if the disabled vehicle wasn’t reasonably avoidable, it would put the focus on why that vehicle was there and why it wasn’t clearly visible. There aren’t enough details in these early reports to say one way or the other how avoidable this crash was.
