Houston, TX — June 8, 2024, Anndy Gomez and one other were injured following an alleged drunk driver accident at around 5:25 a.m. on Westpark Tollway.

Investigators said in preliminary statements that the accident happened in the area of the Highway 6 interchange near Mission Bend.

According to officials, 22-year-old Anndy Gomez was in a Chevy Silverado going westbound on the tollway. A Honda Element was reportedly going eastbound on the wrong side of the road, resulting in the vehicles colliding head-on. As a result, both Gomez and the Honda driver had serious injuries.

Authorities allege that the Honda driver was under the influence of alcohol at the time of the crash. Frankly, it’d be more surprising if this didn’t involve alcohol. It’s almost always the reason someone gets on the wrong side of a divided highway. But what’s really concerning is wrong-way drivers are usually extremely intoxicated, and that often means they were illegally over-served by a bar. That’s a possibility that needs to be considered.

For example, I had a case not long ago involving a drunk driver who went into oncoming traffic and hit a family head-on, nearly killing a young kid. When we retraced the driver’s steps, we found he’d been drinking at a happy hour for a few hours. The bar recklessly over-served him to the point he could barely walk, yet they kept pouring drinks until he finally closed his substantial tab and stumbled out to his car. With that evidence, the establishment was held accountable for contributing to what was nearly a deadly accident.

The challenge in these situations is that authorities don’t often look into this possibility on their own. In the above example, we were the only ones investigating the negligent bar. That’s often been the case across many of the hundreds of cases I’ve handled against negligent alcohol providers. Authorities are especially motivated to charge drunk drivers, but once they do so, they tend to move on. That’s why it’s important for victims and their loved ones to know about these possibilities so they can make sure investigators are getting the full story and not letting any wrongdoers off the hook.
