Commentary by Attorney Michael Grossman

An alleged hit-and-run is serious enough—as is an alleged drunk driving accident. But the alleged drunk driver being a teenager only raises more significant red flags. One reason for that is it brings up the serious question of where that driver may have got their alcohol from. That’s where things can become rather complex. Let me explain.

I’ve handled hundreds of alcohol-related accident cases involving drunk drivers. Something that too often goes overlooked is the role alcohol providers play in serious accidents. Authorities tend to put all of their focus on the drivers, then move on once there are charges filed.

However, I’ve seen first hand how negligent alcohol providers can contribute to serious and deadly accidents. And if there’s an establishment willing to sell to teenagers, then it’s usually the case they’re breaking all kinds of other rules. For example, they may have also unlawfully over-served the alleged drunk driver, which could mean that the alcohol provider is responsible for contributing to the crash under Texas dram shop law.

Think of it this way. Focusing solely on the actions of an alleged wrongdoer, regardless of their age, may yield appropriate consequences for that individual. However, it may not do much for victims and families in need of help, and it might overlook a local establishment who is putting the community in danger. Extending the investigations to consider all of the factors leading up to an accident can help address all three.
