UPDATE (October 11, 2023): Recent statements from investigators suggest that alcohol consumption may have played a role in this accident.

Commentary by Attorney Michael Grossman

Before anyone jumps the gun and says, “Well, that’s that,” this revelation raises an important question. Did someone else play a role in this crash? Now, I know you may be thinking “This is a single-vehicle crash—how can anyone else be involved?” Allow me to explain.

I had this case not long ago which involved a man who drank at a bar, then tried to walk home while intoxicated. Unfortunately, the man didn’t get very far before stumbling off the walkway and down an embankment, causing him to suffer a severe brain injury. Everyone in the public who read about that accident quickly jumped to ridicule the man and blame him for his own devastating accident. But when authorities looked into it, they found clear evidence that the bar illegally over-served the man.

So while I was not involved in the criminal side of that situation (I handled the personal injury case against the bar), the authorities pursued criminal charges against the bartender for their actions.

Anytime I tell someone about that story, it opens their eyes to the importance of reserving judgment after a serious accident. Many times, there’s more to the story.
