Aguilar had apparently moderate injuries, and the other driver was reportedly charged by Harris County officials with Failure to Stop and Render Aid. They also allege that the driver had been under the influence of alcohol at the time. If that’s true, it wouldn’t be too surprising. It’s a common reason drivers try to flee the scene. But while it’s encouraging authorities caught the alleged drunk driver, there may be an accomplice out there they have yet to confront.
With details like these, it’s important to ask: Was this driver illegally over-served by a local alcohol provider? Many accidents like this involve people over-served while obviously intoxicated, which can land alcohol providers in a world of trouble. I’ve had hundreds of liability cases against those negligent providers, and they can also be subject to criminal investigations, fines, and license suspensions.
Unfortunately, a lot of alcohol providers slip under the radar. Unless victims happen to speak to someone who’s experienced in seeking them out, they often get off scot-free while authorities put all of the focus on the drunk drivers. But those businesses broke the rules, too, and they have legal consequences to face for those mistakes. That’s why it’s important to consider this possibility after any accident that may involve alcohol, and I don’t see why this incident would be an exception.
