Commentary by Attorney Michael Grossman
A crash where a vehicle crosses the median and collides with a garbage truck raises serious questions about why the driver lost control in the first place. While authorities will likely focus on the sedan’s movements, my experience handling truck accident cases tells me that a proper investigation should go beyond that and examine every factor that may have contributed to this fatal collision.
One key issue is whether road design played a role. Some medians are poorly maintained or lack barriers that could prevent vehicles from crossing into oncoming traffic. If this stretch of West Cheyenne Avenue has a history of crossover crashes, that could indicate a need for better median protection. Investigators should also consider whether road conditions — such as debris, potholes or uneven pavement — may have caused the driver to lose control.
Another important question is why both vehicles caught fire after impact. While severe crashes can lead to fires, vehicle design and maintenance often play a role in how quickly they ignite. Was the garbage truck carrying any hazardous materials or flammable substances? Was there a mechanical issue, such as a fuel system failure, that contributed to the fire? Fires like these don’t just happen: they result from specific conditions that need to be examined.
Lastly, vehicle condition should be investigated. Did the sedan experience a tire blowout, brake failure or steering issue that caused the driver to lose control? Regular maintenance records should be reviewed to determine if a mechanical issue played a role in the crash.
This tragic wreck isn’t just about a car crossing the median: it’s about understanding why that happened to provide answers for the victims’ families. A thorough investigation should consider road design, vehicle conditions and fire risks to ensure the full story comes to light.
