Commentary by Attorney Michael Grossman

When I see a report like this, my first question is why the Dodge driver veered off the road in the first place. Losing control and then overcorrecting into oncoming traffic is a common sequence in serious crashes, but the key issue is what caused that initial departure from the roadway.

There are a number of possibilities. Driver distraction or fatigue could have played a role. Mechanical failure, like a tire blowout or steering issue, is another possibility. Road conditions, such as ice or an obstacle on the shoulder, may have also contributed. A proper investigation should examine all these factors, rather than just assuming driver error.

From the truck driver’s perspective, this situation often is almost impossible to avoid. A vehicle suddenly crossing into their lane leaves little time to react, especially in a fully loaded semi-truck that requires far more distance to slow down or maneuver. That’s why investigators should look at any available evidence — dashcam footage, black box data and eyewitness accounts — to understand the timing of events.

At this point, we don’t have enough information to say exactly what went wrong. But if authorities stop at surface-level conclusions without digging deeper, they may miss the real cause of this crash.
