Commentary by Attorney Michael Grossman

Authorities allege that the driver of the Kia was under the influence of alcohol at the time of the crash. It wouldn’t be at all surprising if that turned out to be true. Alcohol is far and away the most common reason drivers get on the wrong side of a divided roadway. Obviously that would warrant consequences, but more than that, it’s important after any wrong way accident to find out if there’s an alcohol provider responsible for negligently over-serving the drunk driver.

Essentially, alcohol providers in Texas who unlawfully over-serve drivers that are obviously intoxicated can potentially face criminal investigations, license suspensions, fines, and liability for the resulting harm. I’ve handled hundreds of cases involving negligent alcohol providers responsible for contributing to serious accidents. The ones involving wrong-way drivers were some of the most egregious examples of bars and other providers breaking the law with no regard for the safety of others.

That’s why it can be frustrating see accidents like these where authorities only care to go after the wrong way driver. Victims and families affected by these wrecks deserve to know all parties responsible are facing appropriate consequences. So if authorities here are only investigating as far as the crash scene itself, they could be overlooking something crucial.
