Jasper County, TX — April 18, 2025, a woman and a child were killed and Anais Peralta was injured following a wrong-way car accident at 8:15 p.m. on US 96.

Preliminary information about the accident says that the crash took place south of Buna near County Road 791.

According to officials, Anais Peralta and a 7-year-old child were in a Kia Sportage traveling southbound along US 96. A Hyundai Elantra going northbound reportedly entered southbound lanes, and the two vehicles collided head-on.

Due to the crash, the driver of the Hyundai and the child riding with Anais Peralta were killed. Anais Peralta reportedly had serious injuries. Right now, authorities allege that the Hyundai driver was over three times the legal limit for drunk driving. Additional details are unavailable.

As shocking as these details are, my concern is whether authorities properly investigated the details leading up to the crash or if they moved on because there wasn’t a driver they could charge. I see that happen all too often after deadly drunk driving wrecks. Put simply, there could be an accomplice to all of this who still needs to be held accountable: a negligent alcohol provider. Let me explain.

In Texas, our legislature recognized the role that negligent alcohol providers can play in deadly accidents when they over-serve people who are already obviously intoxicated. As such, bars, restaurants, liquor stores, and other establishments can be held responsible if their unlawful service of alcohol leads to people getting hurt or killed. If someone is over three times the legal limit, and they had been drinking at a local establishment, it’s virtually guaranteed they were unlawfully over-served.

Here’s why this really matters. Simply put, I’ve handled hundreds of cases involving drunk drivers. Generally speaking, families want to know there will accountability for the harm done to them. If authorities simply move on because there isn’t a driver around to face charges, they risk letting a serious wrongdoer walk away scot-free.

However, if steps are taken to investigate beyond the scene of the crash and find out where the alleged drunk driver got their alcohol from, there is an opportunity to see full accountability for lives being lost. Not only that, but if there’s a negligent alcohol provider in the community serving people so egregiously, they need to be put on the straight and narrow before more people get hurt.
