Brownsville, TX — October 5, 2024, Ana Mena, Abraham Saenz, Amberly Gonzalez, and one other were injured after a car accident at 2:42 a.m. on Expressway 83.

Authorities said in preliminary statements that the accident happened in the area of I-69E/Expressway 77/83 and Highway 100.

According to officials, 23-year-old Ana Mena was a passenger in a Toyota 4Runner which somehow got on the wrong side of the road. Doing so, the Toyota crashed with a Ford Ranger driven by 28-year-old Abraham Saenz and a Chevy Trax driven by Amberly Gonzalez.

Due to the crash, the driver of the Toyota reportedly had serious injuries. Mena, Saenz, and Gonzalez all reportedly had moderate injuries. Right now, additional details remain unconfirmed.

Obviously, any incident involving a wrong-way vehicle is going to raise serious red flags. It’s almost always a sign that intoxicants were involved—usually alcohol. That can lead to concerns about the possibility the driver was unlawfully over-served by a local bar, who may be responsible for contributing to the resulting accident. Unfortunately, I’ve handled hundreds of cases against negligent alcohol providers where authorities simply moved on without looking for a negligent establishment. That’s why it’s important to confirm if authorities are looking into that possibility after a crash like this.

Alternatively, there could be unusual and extenuating circumstances to consider. For example, here in Dallas there was a toll road that had an unusually high number of incidents where drivers got on the wrong side of the road. Research actually revealed the “do not enter” signs were too high, so they were lowered. Lo and behold, the number of wrong-way incidents went down.

This is just an example of why it’s important to avoid jumping to conclusions. Regardless of what likely happened here, the evidence needs to be able to speak for itself, plain and simple. Hopefully steps are being taken here to see that happens so those involved can make an informed decision on what next steps are best for them.
