Commentary by Attorney Michael Grossman
Right now, the cause of the crash hasn’t been confirmed. Experience tells me, though, that a lack of information won’t stop some people from jumping to conclusions.
All the time on this blog, I talk about the importance of considering all possible factors even if they may seem unlikely. Mechanical issues, tire blowouts, faulty brakes, roadway defects, missing signage or lighting—common or not, it’s worth considering. With just about any kind of wreck, people are willing to give people the benefit of the doubt. But when there’s just one vehicle involved, that all goes out the window, and people just assume the driver must have been doing something wrong.
Is that possible? Of course—in fact, it’s the most common scenario. But when authorities are the ones making those assumptions, it can lead them to overlook important details that would set the record straight. I can’t say if anything like that happened here, but if anyone thinks they know what happened here without there being a thorough accident reconstruction, they’re not doing anyone any good.
