Commentary by Attorney Michael Grossman

My first thought after reading about a crash like this is to examine what conditions or actions might have led to the truck flipping over. Incidents involving overturned trucks are often tied to issues like shifting cargo, driver error or roadway conditions.

One critical question is whether the truck’s load of lumber contributed to the crash. Hauling heavy or unevenly distributed cargo can destabilize a truck, especially if the load shifts during travel. Investigators will need to determine whether the lumber was properly secured and whether the truck’s configuration was suitable for the load it was carrying. Improperly loaded cargo is a common cause of truck rollovers and is often tied to both driver responsibility and company practices.

Another area of focus is the driver’s actions. Was the truck traveling at an appropriate speed for the conditions, particularly if the road had curves, inclines or uneven surfaces? Speeding or sudden maneuvers, such as abrupt braking or sharp turns, can make it difficult to maintain control of a large, top-heavy vehicle like a lumber truck. Investigators should review the truck’s black box data to understand its speed and movement leading up to the crash.

The condition of the road itself also warrants attention. U.S. Route 287 in this area may have design features or environmental factors — like sharp curves, narrow shoulders or poor visibility — that could contribute to rollovers. If the crash occurred on a wet or icy surface, that could further complicate the truck’s handling.

Finally, it’s important to examine the mechanical state of the truck. Was the vehicle properly maintained, including its brakes, tires, and suspension system? Mechanical failures can play a significant role in crashes, particularly when hauling heavy loads.

This crash highlights the unique challenges of operating heavy trucks, especially those carrying substantial cargo like lumber. A thorough investigation into the driver’s actions, the condition of the truck and its load and the design and environment of the roadway will be critical to understanding what caused this rollover and identifying ways to reduce the risk of similar incidents in the future.
