Commentary by Attorney Michael Grossman

Whenever alcohol leads to a crash, as is allegedly the case here, folks tend to think everything is open-and-shut. Authorities charge the drunk driver, and that’s that, right? Well, there’s often more to the story. That’s why it’s important investigators are able to answer this question: Was the alleged drunk driver unlawfully over-served by a negligent alcohol provider? Here’s why that matters.

In Texas, alcohol providers who over-serve someone that is obviously intoxicated can expose themselves to multiple potential legal consequences. This can include criminal investigations, fines, suspended licenses, and even liability for the injuries caused by that intoxicated. As such, there are avenues through which victims and families can see those negligent alcohol providers held accountable, which can also make the community safer for everyone by getting negligent alcohol providers to clean up their act.

Unfortunately, this isn’t always a priority for the police. I can’t count how many times across hundreds of cases against negligent alcohol providers that authorities simply moved on once the drivers were in cuffs. Meanwhile, there would be victims and families left in the dark not knowing their rights until they happened to seek out a second opinion. It’s possible authorities here have been more thorough and already took steps to find out where this alleged drunk driver was prior to the crash. If not, though, it certainly wouldn’t be the first time.
