Berkeley County, WV — September 27, 2024, Allen Nance was killed as the result of a semi-truck accident at around 11:30 a.m. on Business Park Drive.

Authorities said in preliminary statements that the collision happened at Business Park Drive and Tabler Station Road, south of Martinsburg.

According to officials, 25-year-old Allen Lee Nance was in a Toyota that was going eastbound on Business Park Drive. At the private drive for Knauf Insulation, it appears a tractor-trailer made a left turn across eastbound lanes, and Nance’s Toyota crashed into the trailer. As a result, Nance was killed.

While details can’t be confirmed at this time, authorities have only mentioned high speeds as a possible contributing factor in the crash. Frankly, that makes me wonder if authorities are actually handling these investigations properly.

I’ve handled hundreds of commercial vehicle accident cases. When an 18-wheeler turns left across lanes of travel, and someone crashes into it, that’s almost always the result of the tractor-trailer failing to yield. Obviously, there can be extenuating circumstances that would make this accident different. But when I see initial details like these, it just reminds me of all the times we had to conduct exhaustive independent accident reconstructions before authorities finally focused on the real problems that led to a crash.

For example, I handled one a while back with details similar to these. An 18-wheeler was turning across a highway, resulting in a serious accident. The victims was being blamed for driving too fast and not wearing their seatbelt. The family knew their loved one would never be so reckless, so we started digging into the things initial investigations overlooked. For one, a reconstruction of the scene and data from the victim’s car clearly showed they weren’t going too fast. Second, numerous emergency responders testified they had to cut through the victim’s seatbelt to get them out of the wreckage. Along with other information from the accident reconstructions, we made it undeniable the truck driver was in the wrong. It was only after all that the family was able to pursue a proper resolution.

That’s why, whatever happened here, chances are the details will be better off in the hands of independent investigators. Maybe authorities are working hard behind the scenes to get clear answers here. Even when that happens, an independent investigation can reassure a victim’s loved ones they’re getting the whole story. Otherwise, if investigations do show someone’s negligence led to a fatal crash, there needs to be clear evidence to prove that so they’re not let off the hook.
