Commentary by Attorney Michael Grossman
The driver of the Ford was reportedly arrested for intoxication assault. Authorities didn’t say whether the intoxicant was drugs or alcohol. Believe it or not, that’s a significant distinction.
Folks tend to think of these crashes only in terms of the intoxicated drivers and the people they hit. In a lot of crashes like this, further investigations show the driver was illegally over-served by a bar. They, too, can be held accountable for their actions leading to a serious accident. Simply put, following hundreds of cases against negligent alcohol providers, I have yet to encounter an alcohol provider that faced charges, liability, fines, or penalties that didn’t then clean up their act.
So when folks demand justice after an intoxicated driving accident, remember that a driver in cuffs might not be the end of the story.
