Man Injured in Alleged Intoxicated Driver Accident on Ayers Street in Corpus Christi, TX

It appears that a 34-year-old man was on a bicycle going turning right through the Gollihar intersection to go south on Ayers. The cyclist reportedly completed the turn before a Chevy Silverado, also going southbound, crashed into the man from behind. As a result, he had serious injuries.

Authorities say they recommended multiple charges against the driver, including intoxication assault and accident involving injury or death. If the allegations are true, then do authorities think drugs or alcohol contributed to the crash? Let me explain why that distinction really matters.

Simply put, whenever alcohol contributes to a crash, the drunk driver is often just one of multiple people who need to be held accountable. Namely, if a bar illegally over-served them, they, too, can be on the hook. Whether that takes the form of criminal charges for the servers, liability for victims’ injuries resulting from the over-service, or fines and license suspensions from the Texas Alcoholic Beverage Commission, there are multiple paths that can help ensure a negligent alcohol provider is actually held accountable.

Unfortunately, that’s an area of Texas law that even authorities don’t talk about often. I can’t count how often our firm has been investigating a negligent bar for a personal injury case just to find we’re the only ones taking any kind of steps to hold them accountable. Perhaps authorities here are being more thorough—I’d be pleased hear that. But more likely than not, if there is a negligent alcohol provider responsible for this accident, they’ll likely fly under the radar unless someone drags them out into the light.
