If the allegations here are true, then it’s a positive sign the driver is going to answer for what happened here. However, is that really all there is to the story? I’ve handled hundreds of alcohol-related accident cases. Often, there is an accomplice that authorities tend to overlook: a negligent alcohol provider. Let me explain.
Texas dram shop laws prohibit alcohol providers from serving alcohol to someone who is obviously intoxicated. If the driver in this case had been drinking at a bar or restaurant before the crash and was over-served, that establishment may also share responsibility for what happened.
As such, negligent alcohol providers should also get attention if they contribute to a serious accident. Otherwise, it allows them to continue putting lives at risk. Not only that, but victims and families deserve to know all who wronged them will be held appropriately accountable. Whether or not those steps are being taken here remains to be seen.
