Commentary by Attorney Michael Grossman
A crash involving an allegedly intoxicated driver raises important questions not just about the driver’s actions, but about where he was drinking before getting behind the wheel. More often than not, these investigations stop at charging the driver, but that doesn’t always tell the full story.
Texas law makes it illegal for bars and restaurants to serve alcohol to someone who is obviously intoxicated. If an alcohol provider ignored those rules and continued serving this driver past that point, they could share responsibility for what happened under dram shop laws. Identifying where the driver was drinking is a key step in determining whether unlawful alcohol service played a role in this crash.
Holding drunk drivers accountable is important, but preventing these crashes in the first place matters even more. A thorough investigation into where this driver obtained alcohol could help ensure that any business breaking the law faces consequences, potentially preventing future crashes before they happen.
