Commentary by Attorney Michael Grossman
Authorities allege that the Dodge driver was under the influence of alcohol at the time, and authorities recommended charges for intoxication assault. If the allegations are true, then surely those actions call for consequences. But people don’t often know that there may an accomplice who also needs to be held accountable: a bar.
Let me give an example. Not long ago, I had a case involving a drunk driver who went into oncoming traffic and hit a family’s car, nearly killing their son. We started retracing the driver’s steps to find out where he’d been drinking, which the family thought was odd. However, they soon found out why that was so important. Evidence showed that bar recklessly and illegally over-served the driver beyond the point he was a clear danger to others. Not only did that open the bar to potential liability for the resulting accident, but it exposed them to potential criminal investigations, fines, and even suspension of their license to sell alcohol.
Like in many of the hundreds of cases I’ve handled against negligent alcohol providers, that family was shocked authorities hadn’t already been investigating the bar themselves. Unfortunately, that happens all too often. It’s usually our firm bringing evidence to authorities on a silver platter that gets them to finally take action beyond only charging the individual drunk driver. It’s possible this accident doesn’t involve those factors, but it’s something I always shine a light on whenever I can. That way, people can at least know what legal avenues may be available following a serious alcohol-related accident. If there’s some other wrongdoer out there, they shouldn’t be let off the hook just because no one bothered looking for them.
